Terms of service

These Terms of Service (“Terms”) govern your access to and use of American Grill Supply websites, products, and services (“Services”). By visiting our site, placing an order, creating an account, or using any feature, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy, Warranty Policy, and California Privacy & Consumer Disclosure (together, the “Policies”).

1) Eligibility & Accounts

  • You must be at least 18 years old and able to enter a binding contract.

  • Keep your account credentials confidential; you’re responsible for all activity under your account. Notify us immediately of any unauthorized use.

2) Orders, Acceptance & Availability

  • Your order is an offer to buy. We may accept or decline for any reason (e.g., payment issues, suspected fraud, item unavailable, pricing/description errors).

  • If an item is unavailable after you order, we’ll cancel and issue a refund for that item.

3) Pricing, Errors & Taxes

  • Prices are listed in USD and exclude applicable taxes unless stated otherwise.

  • We strive for accuracy but may cancel or update orders with obvious errors (pricing, availability, specs).

  • Sales tax is calculated at checkout based on the ship-to address and applicable laws.

4) Payments & Financing

  • We accept major cards and supported wallets; see our Payment Policy for methods and rules.

  • Financing (e.g., Shop Pay/Affirm) is offered by third-party lenders and subject to their terms. We are not the lender.

5) Shipping, Risk of Loss & Title

  • Shipping options, timing, and costs are described in our Shipping Policy.

  • Large items may ship by LTL freight with curbside delivery and appointment.

  • Risk of loss passes to you upon delivery as shown by the carrier’s records (including signed delivery receipts or “Delivered” scans for parcels).

  • Do not schedule installers until you receive and inspect your order.

6) Inspection, Damages & Missing Items

  • Inspect freight deliveries before signing; note any damage or shortages on the delivery receipt.

  • Report concealed damage or missing items within the time frames in our Shipping Policy.

  • Failure to follow these steps can limit available remedies.

7) Returns, Refunds & Cancellations

  • Return eligibility, restocking fees, deadlines, and RMA procedures are set out in our Refund Policy.

  • Custom/built-to-order items are generally final sale and non-cancellable once in production.

  • Approved refunds are issued to the original payment method.

8) Warranties

  • Products are covered by the manufacturer’s warranty (where offered). Coverage varies by brand and component; see product pages and our Warranty Policy.

  • We make no independent warranties beyond those provided by manufacturers.

  • Site content is provided “AS IS” without warranties of accuracy, completeness, or fitness for a particular purpose to the fullest extent permitted by law.

9) Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, punitive, or consequential damages (including lost profits, business interruption, or installation costs).

  • Our total liability for any claim relating to a purchase is limited to the amount you paid for the product giving rise to the claim.

  • Some jurisdictions do not allow certain limitations; your rights may vary.

10) Product Information & Professional Use

  • Specs, cutout dimensions, and compatibility are provided by manufacturers and may change.

  • Gas/electrical work should be performed by qualified professionals and in accordance with local codes and the manufacturer’s instructions. Improper installation can void warranties and pose safety risks.

11) Promotions, Price Match & Gift Cards

  • Promotions are limited-time and may have additional terms. Unless stated, offers can’t be combined and don’t apply to prior purchases.

  • Our Price Match covers authorized dealers’ delivered prices per posted rules.

  • Gift cards/store credit are not redeemable for cash unless required by law.

12) User Content (Reviews, Photos)

If you submit reviews, ratings, photos, or comments (“User Content”):

  • You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and distribute the User Content in connection with our Services and marketing (with the right to sublicense).

  • You represent that you own or control the rights to your User Content and that it does not infringe others’ rights or violate law.

13) Prohibited Uses

You agree not to:

  • Violate any law or third-party rights;

  • Attempt to interfere with site security, payments, or logistics;

  • Use bots/scrapers that degrade service;

  • Submit false orders, chargebacks, or fraudulent claims.

14) Intellectual Property

All site content, trademarks, logos, and product images (other than User Content) are owned by us or our licensors and protected by law. No license is granted except as necessary to use the Services for personal, lawful shopping.

15) Third-Party Services

Our site may link to or integrate third-party services (payment gateways, financing, shipping portals, reviews, analytics). We do not control third-party terms or privacy practices; review their policies before using those services.

16) Privacy

Your use of the Services is also governed by our Privacy Policy and any applicable regional notices (e.g., CPRA). You can manage cookie preferences on our site; we honor Global Privacy Control (GPC) signals for that browser/device.

17) Suspension & Termination

We may suspend or terminate access for suspected fraud, abuse, non-payment, or violation of these Terms. You may stop using the Services at any time. Sections that by nature should survive (e.g., payments due, IP, warranties, liability, dispute terms) will survive termination.

18) Changes to the Services or Terms

We may update the Services and these Terms at any time. We’ll post the revised Terms with an updated Effective date. Continued use after changes means you accept the updated Terms.

19) Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Where permitted, disputes shall be brought in state or federal courts located in Los Angeles County, California. You and we waive class actions to the extent allowed by law. (If your local law requires different venue/rights, those requirements control.)

20) Severability & Entire Agreement

If any provision is found unenforceable, the remaining provisions remain in effect. These Terms, together with the Policies, are the entire agreement between you and us regarding the Services and supersede prior understandings on the subject.
